3. No Legal, Tax, Accounting, or Financial Advice

4. Title Insurance and Title Information

NEVER SEND FUNDS OR RELY ON NEW OR CHANGED WIRE INSTRUCTIONS BASED SOLELY ON AN EMAIL, TEXT MESSAGE, OR OTHER ELECTRONIC MESSAGE. BEFORE SENDING FUNDS, INDEPENDENTLY VERIFY WIRE INSTRUCTIONS BY CALLING A TRUSTED PHONE NUMBER YOU HAVE PREVIOUSLY CONFIRMED FOR LUMINARY TITLE GROUP OR THE APPLICABLE CLOSING PROFESSIONAL. DO NOT USE A PHONE NUMBER CONTAINED ONLY IN A SUSPICIOUS OR UNEXPECTED MESSAGE.

If you receive a request to change wiring information, payment instructions, account information, or other sensitive transaction details, contact Luminary Title Group through independently verified contact information before taking action. We are not responsible for losses caused by a user's failure to follow reasonable verification procedures, to the fullest extent permitted by law.

7. Information You Submit

You agree that information you submit through the Site will be accurate, current, and complete to the best of your knowledge. You may not submit information that is fraudulent, unlawful, misleading, defamatory, infringing, malicious, or designed to interfere with the Site.

Do not submit passwords, full payment card information, wire instructions, bank account credentials, Social Security numbers, or other highly sensitive information through a general website form unless the form specifically requests the information and is designated for secure transmission.

You represent that you have the right and authority to provide any information or documents you submit to us.

8. Electronic Signatures and Records

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LUMINARY TITLE GROUP AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING SOLELY FROM USE OF THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT, IF ANY, YOU PAID US SPECIFICALLY FOR ACCESS TO THE SITE DURING THE TWELVE MONTHS BEFORE THE CLAIM OR $100.

These limitations do not apply where prohibited by law and do not modify obligations or remedies established by separate controlling transaction documents.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any legal action arising solely from these Terms or use of the Site will be brought in the state or federal courts located in Sumner County, Tennessee, unless applicable law requires otherwise.

Nothing in this section changes any governing-law, forum, dispute-resolution, or venue provision contained in a separate transaction-specific agreement or insurance policy.

18. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on the Site with an updated effective date. Your continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by law.

Material changes will apply prospectively unless otherwise required or permitted by law.

19. Severability, Waiver, and Assignment

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Our failure to enforce a provision is not a waiver of that provision or any other right.

20. Entire Agreement for Website Use

They do not replace or modify any separate agreement governing a real estate transaction, title order, closing, settlement, escrow, insurance product, or other service.
